Acceptance of Terms
By accessing our website or enrolling in any Divergence Academy program, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, please do not use our services.
Use of Services
Divergence Academy provides workforce training, certification preparation, and corporate training services. Our services include but are not limited to:
- Certification prep courses (PECB, ISACA, CMMC, and other programs)
- Corporate training and custom development programs
- Access to our learning platforms and educational materials
- Career services and professional development support
You agree to use our services only for lawful purposes and in accordance with these terms. You must not use our services in any way that could damage, disable, or impair our website or interfere with other users.
Intellectual Property
All content, materials, software, and technology provided by Divergence Academy — including but not limited to course curricula, The Scaffold learning platform, Course Factory course development engine, Career & Skills Passport, training materials, logos, and website content — are the intellectual property of Divergence Academy or its licensors.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of our proprietary content without prior written consent. Course materials provided during enrollment are licensed for your personal educational use only.
Student Responsibilities
Students enrolled in Divergence Academy programs agree to:
- Attend scheduled sessions and complete assigned coursework
- Maintain academic integrity and refrain from plagiarism or cheating
- Treat instructors, staff, and fellow students with respect
- Comply with all program-specific policies and codes of conduct
- Not share login credentials, course materials, or proprietary tools with unauthorized parties
- Provide accurate and up-to-date enrollment information
Payment, Refunds, and GI Bill
Tuition and fees are outlined in your enrollment agreement. Payment terms, installment plans, and financial aid options (including GI Bill benefits for eligible veterans) are detailed in your individual enrollment documentation.
Refund policies are governed by your enrollment agreement and comply with applicable state regulations and VA requirements for GI Bill students. Requests for refunds must be submitted in writing to hello@divergence.one.
GI Bill-eligible programs are approved by the Texas Veterans Commission and the State Approving Agency. Veterans using GI Bill benefits are subject to additional VA policies regarding attendance, progress, and satisfactory completion.
Limitation of Liability
To the fullest extent permitted by law, Divergence Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of profits, data, or employment opportunities.
Our total liability for any claim arising from these terms or your use of our services shall not exceed the total amount you paid to Divergence Academy in the twelve (12) months preceding the claim. We do not guarantee specific employment outcomes, salary levels, or certification exam results.
Termination
We reserve the right to suspend or terminate your access to our services at any time for violation of these terms, academic dishonesty, non-payment, or conduct that disrupts the learning environment. Upon termination, your right to access course materials and platforms will cease.
You may terminate your enrollment in accordance with the withdrawal procedures outlined in your enrollment agreement. Applicable refund policies will apply.
Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising under these terms shall be resolved in the courts located in Dallas County, Texas.
Changes to These Terms
We may update these Terms of Use from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
